Iraq: Senate Bill Banning IG Review Unconstitutional

By banning audits of the Iraq reconstruction, the RNC and Senate have violated the US Constitution.



It is unconstitutional to ban the IG from inspecting:

Article 1 Section 9 Clause 7:
No money shall be drawn from the treasury, but in consequence of appropriations made by law; and a regular statement and account of receipts and expenditures of all public money shall be published from time to time. [AIS9]


5 U.S. 137 [Marbury v. Madison] is precedent for the courts to strike down this Senate Bill as being Unconstitutional.

Options

1. Court strike down the bill;

2. Permit the audit;

3. Return funds to Treasury;

4. Put the Treasury officials in jail for violating the Constitution in paying funds that are not disclosed as required; and/or

5. Begin investigation into the IG for not auditing what they have the lawful obligation to audit, per 5 USC 3331.
